TERMS AND CONDITIONS OF USE BETWEEN 3dleisure EMPLOYEE BENEFITS LIMITED (“3dleisure”) AND THE SCHEME MEMBER (“you” or “your”) FOR USE OF THE 3dleisure SCHEME (“the Scheme”), PROVIDED IN ASSOCIATION WITH INCORPORE LIMITED (“Incorpore”).

1.    By using the Scheme or having the Scheme made available to you, you will be deemed to have accepted and be bound by these Terms and Conditions.

2.     This Scheme is only available to you and your immediate family.  You accept responsibility for restricting access to the Scheme.

3.    Membership of the Scheme will entitle you to access the Scheme website, provided by Incorpore, through which a range of health and lifestyle benefits and discounts are made available to you.  The health and lifestyle benefits and discounts are as specified on the Scheme website, which are subject to change from time to time, without notice.

4.    3dleisure is not liable for the unavailability or suspension of: (i) any particular benefit or discount; or (ii) the Scheme website.

5.    3dleisure reserves the right to refuse access to the Scheme, alter the Terms and Conditions of the Scheme or to withdraw the Scheme in its entirety.  3dleisure will do its upmost to ensure that the availability of the Scheme website will be continuous, however, due to influences beyond 3dleisure’s control on the Internet, this cannot be guaranteed.  Your access to the Scheme website may be occasionally suspended or restricted, without notice, to allow for repairs, maintenance or the introduction of new facilities or services.

6.    The Scheme will be made available to you as an employee benefit.  If you cease employment with your current employer or if your employer withdraws the Scheme, your membership will be cancelled.

7.    The Scheme is only available to residents in the UK and Republic of Ireland.

8.    No cash alternative is available and the Scheme is not transferable.

9.    It is your responsibility to ensure that you meet any requirements for claiming / using any benefit or discount, as applicable, and that you meet and accept any criteria or terms and conditions imposed by Incorpore or the supplier / retailer to whom the benefit or discount relates.

10.    By accepting these Terms and Conditions, you agree that 3dleisure is not liable for any loss, damage or personal injury whatsoever suffered or sustained in connection with the Scheme (including, but not limited to direct, indirect or consequential losses, loss of profit, income or goodwill), the use of any benefit or discount (including but not limited to your failure to meet any criteria imposed by Incorpore or the supplier / retailer to whom the benefit or discount relates) or any act or omission (whether negligent or not) of 3dleisure or its affiliates, save for any liability which cannot be excluded by law (including fraud, gross negligence or for death or personal injury caused by 3dleisure’s or its affiliates’ negligence).

11.    As part of this Scheme: (i) 3dleisure may disclose your contact details to Incorpore: (ii) Incorpore will report uptake of the benefits or discounts offered through the Scheme website to 3dleisure; and (iii) where you qualify and utilise a benefit or discount, Incorpore may securely transfer your contact details to the supplier / retailer to whom that benefit or discount relates.

12.    These Terms and Conditions are governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.
